Terms of Service

1. Agreement to Terms

By creating an account or using Agent Elite, you agree to these Terms of Service. Agent Elite is operated by Execution LLC. ("we," "us," or "our"). If you do not agree to these terms, do not use the platform.

2. Eligibility

You must be at least 18 years old to use Agent Elite. By using the platform, you confirm that you are 18 or older and that your use complies with all applicable laws in your jurisdiction. Agent Elite is intended for use by insurance sales professionals and their organizations.

3. Subscriptions and Billing

Plans

• +Free: 5 recordings per month. No charge.
• +Pro: $69 per month. 300 recordings per month, AI coaching and score breakdowns.
• +Premium: $129 per month. Unlimited recordings, all Pro features, team analytics, Ace, and priority support.

Auto-Renewal

Paid subscriptions renew automatically each month on your billing date. You authorize us to charge the payment method on file through Stripe for each renewal period. Renewal charges apply at the then-current rate unless you cancel before your billing date.

Cancellation

You may cancel your subscription at any time on the web at agentelite.app or by contacting us at support@agentelite.app. Cancellation takes effect at the end of the current billing period. You retain access to paid features until that date.

Refund Policy

All subscription charges are final. We do not issue refunds for partial billing periods or unused recording capacity within a billing cycle. If you believe a charge was made in error, contact us within 30 days of the charge and we will review your case.

4. Acceptable Use

Agent Elite is designed for professional sales coaching within insurance organizations. You agree to use it only for lawful, professional purposes. You may not:

• +Record conversations in violation of any federal, state, or local law.
• +Use the platform for any purpose unrelated to professional sales coaching or training.
• +Share access to your account with other individuals.
• +Attempt to reverse engineer, copy, or reproduce any part of the platform.
• +Upload recordings of conversations that you did not participate in.
• +Use the platform to harass, defame, or harm any individual.

5. Recording Consent

Recording laws vary by location. Some states and jurisdictions require the consent of all parties to a conversation before it may be recorded (two-party consent). Other jurisdictions require only one party's consent. Federal law requires at least one party's consent.

You are solely responsible for complying with all recording consent laws that apply to your location and the location of the other parties in any conversation you record. Before recording any conversation, you must obtain whatever consents are required by law.

Execution LLC. is not responsible for any legal liability arising from your failure to obtain proper consent before recording.

6. Intellectual Property

The Agent Elite platform, including its design, software, scoring algorithms, and all associated content created by Execution LLC, is owned by Execution LLC and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the platform without our written permission.

You own your recordings. By uploading a recording to Agent Elite, you grant Execution LLC. a limited license to process, transcribe, and analyze that recording for the purpose of delivering coaching results to you and authorized members of your organization. We do not use your recordings to train AI models or share them outside your organization.

7. Disclaimer of Warranties

Agent Elite is provided "as is" without warranties of any kind, express or implied. We do not warrant that the platform will be error-free, uninterrupted, or free of security vulnerabilities. AI-generated coaching scores and analysis are provided for informational purposes only and do not constitute professional advice. Actual performance results depend on many factors outside our control.

8. Limitation of Liability

To the maximum extent permitted by law, Execution LLC. and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Agent Elite, including lost profits, lost recordings, or loss of business opportunity. Our total liability for any claim arising from these terms or your use of the platform is limited to the amount you paid us in the 12 months preceding the claim.

9. Termination

You may delete your account at any time from the Profile tab in the app. Deletion permanently removes all of your data from our systems and cannot be undone.

We reserve the right to suspend or terminate your account if you violate these Terms of Service, engage in fraudulent activity, or use the platform in a way that causes harm to other users or to Execution LLC. We will provide notice where reasonably practicable before taking such action.

10. Governing Law

These Terms of Service are governed by the laws of the United States. Any disputes arising from these terms or your use of Agent Elite shall be resolved through binding arbitration, except where prohibited by law.

11. Changes to These Terms

We may update these Terms of Service at any time. When we do, we will update the effective date at the top of this page. If we make material changes, we will notify you by email or through the app. Continued use of Agent Elite after updated terms are posted means you accept the revised terms.
